Nobody hires a family lawyer for fun, and worrying about cost on top of everything else is normal. This page explains how family-law fees actually work, what drives them up or down, and how we approach the money conversation, which starts, deliberately, with 30 minutes that cost you nothing.
How family lawyers charge in BC
Most family-law work is billed one of three ways:
- Hourly billing is the traditional model: you pay for the time your matter actually takes. Fair for unpredictable work, but the total depends heavily on how much conflict the case generates.
- Fixed fees for defined pieces of work: some discrete tasks, like reviewing a separation agreement someone else drafted or providing independent legal advice before you sign, can be quoted as a single price so you know the cost before you commit.
- Retainers: an amount paid up front that your lawyer bills against, replenished as the work continues. A retainer is not the total price of your case; it's a deposit against ongoing work, and unused amounts are returned.

What actually drives the cost
Two families with the same legal issues can have very different legal bills. The biggest cost drivers are:
- Conflict level. Every angry round of correspondence, every contested application, every issue that can't be agreed costs money. This is the single biggest variable, and the one you have the most influence over.
- Process choice. Negotiated agreements and mediation generally cost a fraction of contested court proceedings. Because mediation and arbitration run in-house here, choosing the lower-cost path doesn't mean changing firms.
- Financial complexity. Businesses, multiple properties, or disputes about hidden income take more work than straightforward finances.
- Disclosure cooperation. When both spouses exchange financial information honestly and promptly, costs drop. Chasing disclosure is expensive.
Ways to keep costs down
- Consider mediation first. One professional, one process, and you keep decision-making power. It isn't right for every case, but when it fits, it's usually the least expensive path to a binding resolution.
- Ask about unbundled help. You don't always need full representation. Coaching before mediation, document drafting, or advice at key moments can be retained as discrete services.
- Come organized. Financial documents gathered, timeline written down, questions listed. Organized clients get more from every billed hour.
- Pick your battles. A lawyer who tells you when a fight isn't worth its cost is saving you money. Expect that honesty here.
Legal aid and lower-cost options
If cost puts a lawyer out of reach, you may qualify for coverage through Legal Aid BC, which funds family-law help in defined situations. No lawyer can truthfully quote a total for a contested family matter at the first meeting. Anyone who does is guessing.
