Legal Aid for Family Law in BC

We Accept Legal Aid

Many family law firms do not take legal aid files. We do. SiLaw Group Family Lawyers accepts legal aid clients in family matters. If Legal Aid BC has approved you for a family lawyer, or you think you might qualify, you are welcome here.

SiLaw Group is a boutique family law and mediation firm in South Surrey. Family law is the only kind of law we practise, and we serve clients in English and Punjabi. This page explains what Legal Aid BC covers in family cases across British Columbia, who may qualify, and how retaining us through legal aid works in practice.

What Legal Aid BC Covers in Family Matters

Legal Aid BC states that it will pay for a lawyer to represent you if your legal problem is covered by its rules, you meet its financial guidelines, and you have no other way of getting legal help. Serious family problems are one of its coverage areas, alongside matters like child protection. The details are on its legal representation page.

For family cases, the examples Legal Aid BC gives on its family problems page include, as of September 2026:

  • Serious family situations. Needing an immediate court order for your safety or your children's safety, a serious denial of parenting time or contact, a threat to remove your children permanently from the province, or a child being unlawfully kept from you during your parenting time.
  • Other situations, depending on funding and a merit test. Serious legal issues in high conflict cases, court-related harassment by an ex-partner, and cases where emotional abuse, psychological trauma, or mental illness makes it impossible to represent yourself.
  • Limited services under pilot projects. Help preparing for mediation, negotiating an agreement, or getting ready to represent yourself in matters like child support, spousal support, parenting arrangements, and family property.

Legal Aid BC is clear that this is not a complete list and that coverage decisions are made case by case, with some services depending on available funding. It also notes that its limited representation contracts for family issues do not include divorce. Read its pages directly, since coverage rules can change.

Who May Qualify?

Two things have to line up, according to Legal Aid BC's Do I qualify page: your legal problem must be covered, and your net monthly household income and assets must be at or below its financial guidelines. The income limits vary by household size, and Legal Aid BC publishes the current table on that page. An intake legal assistant calculates your net household income, looks at your assets, and makes the eligibility decision. No lawyer, including us, can promise in advance that you will qualify.

What Happens After I Apply?

You apply to Legal Aid BC directly, by phone through its Call Centre, online, or in person at a legal aid location. Its how to apply page walks through each route. If your application is approved, Legal Aid BC issues a contract for a lawyer to handle the covered services in your case, and Legal Aid BC pays the lawyer under that contract. If you are refused, Legal Aid BC says you may reapply later if your situation changes or you have more information to add.

How Do I Retain SiLaw Group Through Legal Aid?

The short version: apply to Legal Aid BC first, then connect with us. If you are approved and would like our firm to act, let us know and tell Legal Aid BC. If we have room and the contract fits the work, we take the file. From that point you are our client like any other, with the same lawyers and the same standard of care. The main difference is that the scope of the work comes from the legal aid contract, and we will explain at the start what that scope does and does not cover.

What to Bring

For the legal aid application itself, Legal Aid BC asks for complete and true information about your legal problem, income, savings, and assets. Its site lists proof such as two recent pay stubs, a recent welfare stub, or a recent income tax return or bank records if you are self-employed, plus proof of the value of your assets and any papers about your case, like court orders. Some people facing barriers, such as homelessness or having no income, may not need to provide proof.

For your first meeting with us, the same file of documents does double duty. Our guide on what to bring to your first meeting has a practical checklist.

One caution worth knowing before you start: Legal Aid BC states that if your financial situation improves you may become responsible for paying your lawyer, and if you receive money from the resolution of your case you may have to repay Legal Aid BC some or all of what it paid. Ask the intake worker how this could apply to you.

What If I Do Not Qualify?

Not qualifying for a legal aid lawyer does not mean going without help. Legal Aid BC notes that you may still be eligible for its legal advice services, and its legal information is free to everyone. On our side, we built our practice around affordable options for exactly this gap: discrete flat fee tasks described on our pricing and fees page, and the approach we describe in our post on unbundled services when hourly fees are out of reach. Frequently Asked Questions

Does SiLaw Group Really Accept Legal Aid Family Files?

Yes. We accept legal aid clients in family matters. Approval and coverage decisions belong to Legal Aid BC, not to us, so the first step is applying through Legal Aid BC. Once a contract is in place, we can act for you under it.

Is a Legal Aid Lawyer a Lesser Lawyer?

No. You get the same lawyers, the same advice, and the same effort as any private client of this firm. What differs is who pays and what the contract covers, not the quality of the work.

How Long Does the Legal Aid Application Take?

Timing rests with Legal Aid BC and depends on how you apply and how complete your information is. Having your income proof, asset information, and court papers ready when you contact them is the single most useful thing you can do to speed it up.
