Family Law Services
Family Lawyers for West Vancouver Residents
In many West Vancouver separations, the hardest questions are about property. A house in Ambleside or Caulfeild bought decades ago. A recreational property, investment accounts, pensions, sometimes a company one spouse built. Parenting and support still matter, but the centre of gravity in these files is often what the family owns and what it owes. SiLaw Group Family Lawyers works through those questions for West Vancouver residents from our office at Suite 201, 3108 Croydon Drive in Surrey. Consultations happen by video, by phone, or in person, and we say clearly at the outset that this Surrey address is our only office.
When Property Is at the Centre of a Separation
Part 5 of the Family Law Act governs property division in British Columbia, and section 81 of the Family Law Act sets the starting point. On separation, each spouse is generally entitled to an undivided half interest in all family property and is equally responsible for family debt. The real work sits underneath that rule. Some assets may be excluded property, such as what a spouse brought into the relationship, though growth in value during the relationship is usually shared. Pensions and business interests need valuation. A long-held home carries both market value and history. Getting these answers right, and recording them in a separation agreement that will hold, is where careful lawyering earns its keep. This is the work we do most for West Vancouver clients, alongside divorce itself, parenting arrangements, child support and spousal support.
Courts and West Vancouver
West Vancouver has no courthouse. The municipality appears on neither the Provincial Court of British Columbia's official list of court locations nor the province's courthouse directory. The nearest listed courthouse is the Provincial Court in neighbouring North Vancouver at 200 East 23rd Street. Property division, along with the divorce order, is decided by the Supreme Court of British Columbia when a court decision is needed, and we confirm the correct registry for any filing at the consultation. In practice, most property questions are resolved by negotiation or mediation, where the two of you keep control of the outcome instead of handing it to a judge.
Working Together Across the Water
From Dundarave to Horseshoe Bay, working with a Surrey firm is less of a stretch than it sounds, because the file barely travels. Disclosure, valuations, advice and negotiation all move by video, phone and secure email. Mediation runs over video or, when everyone prefers it, in person at our office. Sandy Sihota is an accredited family law mediator, arbitrator and parenting coordinator, so that resolution path is delivered in-house. If you want to read before you talk, our guide to family law issues in BC and our divorce overview are open to everyone. Service is offered in English and Punjabi, with details on our Punjabi services page.
Frequently Asked Questions
We Own More Than We Can Easily Value. Where Do We Start?
With disclosure and a list. The first task in a property-heavy file is a complete picture of what exists, what it is worth and how it is held. Appraisers, actuaries and business valuators are brought in where needed. Decisions made before that picture is complete tend to be the expensive kind, which is why we start there.
Where Are the Nearest Courthouses to West Vancouver?
There is no courthouse in West Vancouver itself. The closest location on the province's official list is the North Vancouver Provincial Court on East 23rd Street. Matters for the Supreme Court of British Columbia, including property division and the divorce order, are filed at a registry we confirm for your specific situation. Most of our files resolve without any courthouse at all.
Does a Long Marriage Change How Property Is Divided?
Length matters to several questions, including spousal support and how much of an excluded asset's growth is shared. The equal-division starting point in section 81 of the Family Law Act applies regardless, but what counts as family property after a 30-year marriage is often a bigger and more interesting question than after a short one. This is exactly what the free consultation is for.
Why Hire a Firm from South of the Fraser?
Because the Family Law Act does not care where your lawyer parks. What matters is how the file is run. Ours is a focused family law and mediation practice where the lawyer you meet is the lawyer who keeps your file, fees are discussed openly through our pricing and fees page, and the first 30 minutes cost nothing.
